Notaries & Gestors
When dealing with legal and administrative matters there are three types of advisors you are likely to come into contact with. The different services provided by a Gestor, Solicitor (Abogado) and Notary are outlined below.
Gestor
The role of the Gestor is pretty much unique to Spain. Gestors emerged when illiteracy in Spain was high and red-tape and bureaucracy was even greater than today. Their role was to fill in forms and deal with administrative matters for ordinary folk.
Gestors today are still widely used by the Spanish, businesses in particular, to deal with employment contracts, tax returns and general administration. Gestors are often listed in directories as 'Asesor Fiscal'. A broad term roughly translated as Accountant/Financial Advisor/Tax Consultant.
A good Gestor can be invaluable. They are likely to have very good local contacts, in Spain as in pretty much the world over, 'who you know' counts for everything.
When choosing your Gestor try to use one that has come highly recommended. It is more than likely your solicitor or agent will have a Gestor they regularly use.
The use of a Gestor to
obtain your NIE
, amongst other things, can be more economical than using a Solicitor. Jobs like these are often handed to Gestors by Solicitors, who then just add their fees on top of the Gestors.
Solicitors
A Solicitor, known as an Abogado in Spanish, fulfils the same role as a Solicitor or Lawyer in the Uk or Ireland. They are highly qualified and will be aware of all the legal issues that they advise on.
Nowadays there are many firms specialising in providing a bi-lingual service for English-speaking clients. Again try to use a firm whose services have been recomended, preferably by another client. As in any country, being highly qualified does not equate to being highly efficient, there are good firms out there and plenty of poor ones too.
Notaries
A Notary is a qualified Abogado who has studied further to become a Notary. The role of the Notary is not quite the same as a Notary Public in the UK.
The role of the Notary in Spain is not to act for individuals but to represent the State. The primary purpose of the Notary is to ensure that contracts between parties are legalized. Hence when you sign your Escitura it will be done before the Notary.
